Empowered Empire Community — Terms & Conditions
JessWhit Fit LLC (“Company”)

By joining the Empowered Empire Community, creating an account, or clicking “Start Membership,” you agree to these Terms & Conditions and our Community Guidelines. These terms govern your Community access, your Project Progress Fitness subscription (monthly or yearly), and use of our training app delivered via PTDistinction. If you do not agree, do not purchase or access the Community.

Subscriptions, Auto‑Renewal, Cancellation

Monthly and Yearly plans auto‑renew until canceled. You authorize recurring charges to your selected payment method.

Cancel anytime online: "My Subscriptions" at projectprogressfitness.com

Cancellations take effect at the end of the current paid term; no prorated refunds. A confirmation email is sent on cancellation.

For California and Colorado customers: we clearly disclose auto‑renewal terms at checkout, send an email acknowledgment with terms/cancel steps, and provide an easy online cancel path. If fees change, we’ll email 7–30 days in advance. Annual subscribers receive an annual reminder.
2. Founders Guarantee (behavior‑based, credit only)

Within your first 30 days only, if you: (a) attend at least 2 live group calls and (b) log/complete at least 5 workouts in the app, and you’re not satisfied, email jesswhitfit@gmail.com within 30 days to receive one free month (credit added to your term; no cash refunds). One per member; non‑transferable; must be in good standing (no past‑due invoices). This is a conditional service guarantee (we add service time rather than refunds).
3. PTDistinction App (training delivery)

“Our app” is provided via PTDistinction. Access is solely to view your assigned training, and log workouts. Do not share access or copy/redistribute content.

Availability: third‑party platforms may experience outages; we aren’t liable for downtime or data loss beyond our control. You must also follow any posted PTDistinction user terms.
4. Community and Content

Community areas include user‑generated posts. Do not share private health info you aren’t comfortable making visible to members. We are not responsible for member posts.

You grant us a limited license to display your posts within the community in program materials. We will request separate written consent before any public marketing use.

Community guidelines (no harassment, hate speech, illegal content, spam, nudity, or attempts to sell/solicit). Violations may result in immediate removal for cause, with access terminated before the next renewal; no refunds for the remaining term. Future auto‑renewals are canceled.
5. User Content; Limited License

Community Content (private use). By posting or uploading any content (text, photos, videos, check-ins, progress updates, comments) in the Project Progress community (“User Content”), you grant Project Progress Fitness a non‑exclusive, worldwide, royalty‑free license to host, store, reproduce, adapt for formatting, and display your User Content inside our private community and in members‑only program materials during your active membership and for reasonable archival purposes thereafter. This license does not allow public advertising use.

Public Marketing Use (opt‑in only). We will not use your name, image, likeness, voice, progress photos, testimonials, or stories in public marketing without your separate, written opt‑in (a “Media Release”). If you sign a Media Release, you may revoke it prospectively by emailing jesswhitfit@gmail.com; revocation will not require us to recall materials already printed, posted, or paid for.

Your responsibilities. You represent that you own or control the rights to the User Content you post and that it does not infringe others’ rights, disclose another person’s private information, or violate law. Do not post protected health information you do not wish to share with other members.

Removal; retention. You may delete your posts at any time. We may retain reasonable backup/archival copies as required for legal, security, or compliance purposes.

No compensation. Unless a separate agreement states otherwise, we do not owe compensation for private community display or any marketing use you separately authorize.
6. Yearly Members — One‑Time Assessment

Yearly plans include one assessment (recommendations only; not medical advice). You must submit the assessment form within 30 days of joining; otherwise, it’s forfeited.

By submitting the form, you assert you are 18+, able to exercise, and understand recommendations are informational, not medical treatment.
7. Health & Safety; No Medical Advice

Coaching, nutrition, and training content is educational and for general wellness. We do not diagnose, treat, or provide medical advice. Always consult your physician before starting or changing exercise/nutrition. You assume all risks from participation, including pre‑existing conditions or injuries. We disclaim warranties to the fullest extent permitted by law and limit liability to the amount you paid in the last 12 months.
8. Payments, Failed Charges, Chargebacks

You authorize us to store your payment method and retry failed payments. Access may pause for non‑payment. Disputes must first be sent to jesswhitfit@gmail.com so we can resolve them quickly.
9. Changes to Terms; Notices

We may update terms; for material changes or fee changes we will provide clear notice and cancel instructions by email that you can retain.
10. Dispute Resolution

Any claim will be resolved individually via binding arbitration in Denver, CO (AAA rules). Class actions are waived. You can opt out within 30 days of acceptance by emailing jesswhitfit@gmail.com
11. Age

Services are for individuals 18+ only.
